Please read these terms of service (“Terms of Service”) and the Services Description (collectively, this “Agreement”) carefully. This Agreement is between you and the Department of Labor and Employment and its Regional Offices, Bureaus, Services and Attached Agencies (“DOLE,” “we,” “us,” or “our”) and governs your access to and the use of Single Entry Approach Information System (“Service”), unless you and DOLE have signed a written Memorandum of Agreement (MOA) or Memorandum of Understanding (MOU), in which case such MOA/MOU will govern your access to and use of the Services rather than these Terms of Service. You may enter into this Agreement on behalf of yourself or on behalf of a legal entity. If you enter into this Agreement on behalf of a legal entity, you represent that you are a duly authorized representative with the authority to bind that legal entity to this Agreement. All references to “you” and “your” in this Agreement mean the person accepting this Agreement as an individual or the legal entity for which the representative is acting.

THE DEPARTMENT
In pursuit of the Department’s mandate, the DOLE shall have the following powers and functions:
- The promotion of gainful employment opportunities and the optimization of the development and utilization of the country's manpower resources;
- The advancement of workers' welfare by providing for just and humane working conditions and terms of employment; and
- The maintenance of industrial peace by promoting harmonious, equitable, and stable employment relations that assure equal protection for the rights of all concerned parties.

POWERS AND FUNCTIONS
In pursuit of the Department’s mandate, the DOLE shall have the following powers and functions:
- Formulate and recommend policies, plans and programs for manpower development, training, allocation, and utilization;
- Protect and promote the interest of every citizen desiring to work locally or overseas by securing for him the most equitable
- terms and conditions of employment and by providing social and welfare services;
- Regulate the employment of aliens, including the establishment of a registration and/or work permit system for such aliens;
- Formulate general guidelines concerning wage and income policy;
- Recommend necessary adjustments in wage structures with a view to developing a wage system that is consistent with national
- economic and social development plans;
- Provide for safe, decent, humane and improved working conditions and environment for all workers, particularly women and young
- workers;
- Maintain harmonious, equitable and stable labor relations system that is supportive of the national economic policies and
programs;
- Uphold the right of workers and employers to organize and to promote free collective bargaining as the foundation of the labor
- relations system;
- Provide and ensure the fair and expeditious settlement and disposition of labor and industrial disputes through collective
- bargaining, grievance machinery, conciliation, mediation, voluntary arbitration, compulsory arbitration as may be provided by
law, - and other modes that may be voluntarily agreed upon by the parties concerned.

SINGLE ENTRY APPROACH (SEnA) PROGRAM
The SEnA program was institutionalized by virtue of Republic Act No. 10396 by the then President Benigno S. Aquino III last 14 March 2013. By 2016, an Implementing Rules and Regulations through the Department Order No. 151 series of 2016 was issued by the Department of Labor and Employment (DOLE) requiring all its offices to establish a Single Entry Assistance Desks (SEADs) including Central/ Regional/ Provincial/ Field/ District Offices of the Department of Labor and Employment, National Conciliation and Mediation Board (NCMB) and its Regional Branches, National Labor Relations Commission (NLRC) and its Regional Arbitration Branches. Pursuant to the constitutional mandate to promote the preferential use of voluntary modes of settling disputes including conciliation-mediation, the DOLE shall:
- provide a speedy, impartial, inexpensive and accessible settlement of labor issues arising from employer-employee relations;
- promote the use of conciliation-mediation in the settlement of all labor cases; and
- strengthen cooperation and coordination between and among DOLE agencies involved in dispute settlement.

DOLE Assistance for Request Management System (DOLE ARMS)
is an information system that allows clients to submit a Request for Assistance (RFA) to any SEAD electronically. It is accessible 24/7 at the websites of the implementing offices and serves as an alternative mode of filing of RFAs. It is a digital platform that is used to store and process information in order to settle/resolve complaints filed by requesting parties.
>Information being used are, but not limited to, the following:
- Personal Information;
- Name;
- Contact Information;
- Address;
- Employment Details;
- Employer Information;
- Employer name;
- Owner and Representative Name;
- Employer Contact Information; and
- Employer Address.
The DOLE ARMS also stores information related to the issue/complaint brought before us including the specific issues or claims and relief prayed for. In the course of settling disputes, we conduct interviews with the requesting party to validate the issue/complaint brought before us. The RFA handlers store collected information and data in the DOLE ARMS. The Single Entry Assistance Desk Officers (SEADO) also utilize the same information in the DOLE ARMS during the conciliation and mediation process. This allows the SEADO to efficiently perform its duty of fully exhausting all possible options for amicable settlement.

ACCESS AND USE
You may use the Service at any time of your convenience. The DOLE ARMS can be found on any of our websites and may be accessed via desktop, laptop, or any device that is connected to an internet connection.
When using our Service, we strongly encourage using a private internet connection rather than a public one to secure information being submitted. We are not liable for any loss of data or information that occurs as a result of using the Service over a public internet connection. This includes, but is not limited to:
- Personal Information;
- Unauthorized access to your data;
- Data corruption or loss; and
- Any other security incidents.
Any data submitted in the DOLE ARMS is only used for the purpose of resolving or settling disputes between the requesting and responding parties. Similar data may also be used by us for the intention of improving the quality of our services through policy formulation. Furthermore, by submitting your data, you also grant us permission to use your information for research and/or academic purposes, and for the purposes of policy and decision making.

END USER RESPONSIBILITIES
As an end user, you will abide by and ensure compliance with all statements under this Agreement. You are responsible for ensuring the correctness of the data you will submit including its legitimacy and accurateness. As the end user, you acknowledge that your usage of the system is of your own free will and that the submission of your data in the system is at your own discretion.
In the process of validating the complaint, you are responsible for answering all questions and validating all information based on what was submitted upon filing. Should you encounter any difficulties in using the system, you may still opt to file a Request for Assistance using a different mode of filing as stipulated in DOLE Department Order No. 151 series of 2016.
You also acknowledge that you remain liable for the acts and omissions of any third party that you allow, enable, or otherwise provide access to the Services whether or not such access was expressly permitted by us. You are responsible for reporting any system malfunctions, security breaches, or suspicious activities to us.
We may investigate any complaints and violations that come to our attention and may take any action at our sole discretion.

PROHIBITED USES
The DOLE ARMS is government property. You agree that you will not modify, customize, create improvements, derive innovations from, reverse engineer, or attempt to gain access to any underlying technology of the Services, including any source code, process, data set, or database, management tool, development tool, server or hosting site. You also agree that you will not engage in activity that is illegal under applicable Law, fraudulent, false, or misleading, and transmit through the Services any material that may infringe, misappropriate, or violate the Proprietary Rights.
As the DOLE ARMS is publicly available, you shall not distribute, publicly display, or publicly perform any content from the Service, nor build or benchmark a competitive product or service, or copy any features, functions, or graphics of the Services without prior written permission. You agree that uploading or transmitting any software, Customer Content, or code that does or is intended to harm, disable, destroy, or adversely affect performance of the Services is strictly prohibited. Furthermore, you shall not remove, delete, alter, or obscure any Proprietary Rights notices provided on or with the Services including any copy thereof.

TERMINATION FROM SERVICE
Any user may terminate their usage from the service at any time following the rules under the DOLE Department Order No. 151 series of 2016 regarding the withdrawal of the requesting party. This is applicable before or during the conduct of the 30-day conciliation-mediation process starting from the date of submission of the complaint in the system.
Upon termination, your submitted data will be stored in accordance with our Privacy Policy.

PROPRIETARY RIGHTS
All content, features, and functionality of the Service, including but not limited to text, graphics, software, logos, and any underlying technology, are the exclusive property of National Conciliation and Mediation Board and are protected by applicable intellectual property laws.

MODIFICATION OF TERMS
We reserve the right to modify this Agreement at any moment at our sole discretion without prior notice. Your continued use of the Service following any such modifications represents acceptance of the new Agreement.

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and any additional policies referenced herein.
